1. Agreement to Terms

By accessing and using the services provided by Desire Care ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Services

Desire Care provides physics education services including:

• Individual tutoring sessions
• Group classes and workshops
• Online learning programs
• AP Physics preparation
• College physics support
• Research mentorship
• Physics olympiad training

3. User Responsibilities

3.1 Attendance and Participation

• Students are expected to attend scheduled sessions punctually
• Active participation and engagement in learning activities is required
• Students must come prepared with necessary materials and completed assignments

3.2 Cancellation Policy

• Sessions must be cancelled at least 24 hours in advance
• Late cancellations (less than 24 hours) may result in charges
• No-shows will be charged the full session fee
• Emergency cancellations will be considered on a case-by-case basis

3.3 Code of Conduct

• Respectful behavior towards instructors and fellow students
• Academic honesty and integrity in all work
• No disruptive behavior during sessions
• Compliance with all applicable laws and regulations

4. Payment Terms

4.1 Fees and Billing

• Payment is due before or at the time of service
• Rates are subject to change with 30 days notice
• Package deals must be paid in full upon enrollment
• Late payment fees may apply to overdue accounts

4.2 Refund Policy

• Refunds for unused sessions may be provided with 7 days notice
• Package deals are non-refundable after 48 hours of purchase
• Refunds will be processed within 5-10 business days
• Administrative fees may apply to refund requests

5. Intellectual Property

All educational materials, including but not limited to:

• Lesson plans and curricula
• Practice problems and solutions
• Video recordings and presentations
• Proprietary teaching methods

Are the exclusive property of Desire Care and are protected by copyright laws. Students may use these materials solely for personal educational purposes and may not reproduce, distribute, or share them without written permission.

6. Limitation of Liability

Desire Care provides educational services to the best of our ability. However, we cannot guarantee specific academic outcomes or test scores. Our liability is limited to the amount paid for services. We are not responsible for any indirect, incidental, or consequential damages arising from the use of our services.

7. Privacy and Confidentiality

We are committed to protecting student privacy and maintaining confidentiality of educational records. Student information will not be shared with third parties without consent, except as required by law. Please refer to our Privacy Policy for detailed information about data collection and use.

8. Technology and Online Services

8.1 Technical Requirements

• Students are responsible for having reliable internet connection
• Compatible devices and software for online sessions
• Backup plans for technical difficulties

8.2 Online Session Guidelines

• Sessions may be recorded for educational purposes
• Students must maintain appropriate online behavior
• Technical issues will not result in automatic refunds

9. Termination

Either party may terminate services with written notice. Desire Care reserves the right to terminate services immediately for violation of these terms, non-payment, or inappropriate behavior. Upon termination, all unused sessions will be refunded according to our refund policy.

10. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through good faith negotiation. If resolution cannot be reached, disputes will be subject to binding arbitration in San Antonio, Texas, under the rules of the American Arbitration Association.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Texas, United States. Any legal action or proceeding arising under these terms will be brought exclusively in the courts of San Antonio, Texas.

12. Modifications to Terms

Desire Care reserves the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

13. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms will remain in full force and effect.
